With Regard to the 9-14-23 IRS Pause on ERC Processing

As you may be aware, the IRS has recently made some changes to the ERC program that we want to address. The reason for these changes is an increasing amount of fraudulence due to unscrupulous companies newly entering the ERC space and not following IRS protocol, or worse, committing intentional fraud. The IRS has been overwhelmed by a great deal of claims over the last three months, many of which are believed not to be compliant with eligibility and qualification rules.

ERC Benefits is not concerned with these program changes as we have always intently followed IRS guidelines for determining eligibility and qualification. We spend a great deal of time collaborating with clients and their trusted advisors to conduct discovery meetings and review the specific data and circumstances of each and every business before making these determinations. Some of the major takeaways:

  1. For claims received before 9/14/2023, the revised processing time is now 180 days.
  2. For claims received after 9/14/2023, these applications will be held until the beginning of the year before they are reviewed and processed.
  3. ERC Benefits will continue assisting clients with determining eligibility and qualification, will continue to qualify wages and calculate ERC, and will be advising clients to file for periods that they qualify for.
  4. With the recent changes and uncertainty, we do not know whether the IRS may make additional changes and/or terminate the program early.
